1. About These Terms

These Terms of Use ("Terms") govern your access to and use of the website located at jesspeletier.com (the "Site"), including all content, resources, lead magnets, registration forms, and booking tools available through it.

The Site is operated by Jess Peletier Coaching trading as Scale School (ABN 23 656 647 979) ("we", "us", "our"). Our principal place of business is on the Sunshine Coast, Queensland, Australia.

By accessing or using the Site in any way — including browsing, submitting a form, downloading a resource, or booking a call — you agree to these Terms. If you do not agree, please do not use the Site.

These Terms should be read alongside our Privacy Policy, which is incorporated by reference.

Note for New Zealand users: If you are accessing this Site from New Zealand, you may have additional rights under the New Zealand Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these Terms is intended to limit those rights to the extent they cannot be excluded by law.

2. Eligibility

By using the Site, you represent and warrant that:

•       you are at least 18 years of age;

•       you have the legal capacity to enter into a binding agreement; and

•       your use of the Site complies with all applicable laws in your jurisdiction.

The Site is intended for use by mortgage brokers and other financial services professionals. It is not directed at consumers seeking personal financial advice.

3. Site Content and Free Resources

We may make available free downloadable resources, guides, templates, and other materials ("Resources") through the Site. Resources are provided for general educational and informational purposes only.

By downloading or accessing a Resource, you agree that:

•       the Resource is provided as-is, without warranty of any kind;

•       we do not guarantee that the Resource will be current, accurate, or suitable for your specific circumstances;

•       the Resource does not constitute legal, financial, compliance, credit, or professional advice of any kind; and

•       you are solely responsible for how you use any Resource.

Resources remain our intellectual property. You may use them for your own internal business purposes only. You may not reproduce, distribute, adapt, or commercialise any Resource without our prior written consent.

4. Forms, Bookings, and Workshop Registrations

The Site allows you to submit enquiry forms, book discovery or strategy calls, register for workshops, and opt in to receive information about Scale School ("Submissions").

By making a Submission, you:

•       confirm that the information you provide is accurate and complete;

•       consent to us contacting you by email, phone, or other means you have provided, in connection with your Submission;

•       acknowledge that submitting a form or booking a call does not constitute enrolment in Scale School or create any contractual entitlement to services; and

•       understand that any enrolment in Scale School is subject to a separate membership agreement and the terms applicable to that program.

We will handle your personal information in accordance with our Privacy Policy and applicable Australian privacy law, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

5. Marketing Communications and Spam Act Compliance

By submitting a form, booking a call, downloading a Resource, or registering for a workshop on the Site, you expressly consent to receiving commercial electronic messages from us, including marketing emails, program updates, and promotional content.

We comply with the Spam Act 2003 (Cth). Every marketing communication we send will:

•       clearly identify us as the sender;

•       include accurate contact information; and

•       include a functional unsubscribe mechanism.

You may withdraw your consent to marketing communications at any time by clicking the unsubscribe link in any email or by contacting us directly. Withdrawing consent will not affect the validity of consent given prior to withdrawal, or our ability to contact you for transactional or administrative purposes related to a Submission you have made.

6. Intellectual Property

6.1 Our Content

All content on the Site — including but not limited to text, graphics, logos, images, video, audio, course materials, frameworks, methodologies, templates, and proprietary systems (including the Social Tsunami™, MAM Method, Hammertime Strategy, 24/7 Client Machine, and all related Scale School frameworks) — is owned by or licensed to Jess Peletier Coaching trading as Scale School and is protected by Australian and international copyright, trademark, and other intellectual property laws.

Nothing on the Site grants you any licence to use our intellectual property except as expressly stated in these Terms.

6.2 Permitted Use

You may access and view Site content for your own personal, non-commercial reference purposes. You may not:

•       copy, reproduce, republish, upload, post, transmit, or distribute any Site content without our prior written consent;

•       use our frameworks, methodologies, or branded systems in your own products, services, or training programs;

•       remove or alter any copyright, trademark, or other proprietary notice; or

•       use any automated tool, scraper, bot, or similar technology to extract data from the Site.

6.3 Your Submissions

You retain ownership of any content you submit to us through the Site. By submitting content, you grant us a non-exclusive, royalty-free licence to use that content for the purpose for which it was submitted (e.g. to respond to your enquiry or process your booking).

7. No Professional or Regulated Advice

The content on this Site is for general educational and informational purposes only. It does not constitute, and should not be relied upon as:

•       financial product advice within the meaning of the Corporations Act 2001 (Cth);

•       credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth);

•       legal, accounting, tax, compliance, or regulatory advice; or

•       advice specific to your individual circumstances.

Jess Peletier Coaching trading as Scale School is a business coaching and marketing education provider. We are not a licensed financial services provider, credit licensee, or legal practitioner. Any content that touches on financial services marketing is directed at licensed mortgage brokers acting in their professional capacity, and is intended to assist with marketing strategy only.

You should seek independent professional advice from appropriately qualified and licensed advisers before making decisions based on anything you read or access on this Site.

8. Third-Party Links and Platforms

The Site may contain links to third-party websites, platforms, or services (including but not limited to booking tools, webinar platforms, membership platforms, and payment processors). These links are provided for convenience only.

We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party website or service. Your use of any third-party platform is governed by that platform’s own terms and conditions and privacy policy.

We are not responsible for any loss or damage arising from your use of or reliance on any third-party platform linked from this Site.

9. Disclaimer of Warranties

To the maximum extent permitted by law, the Site and all content, Resources, and functionality available through it are provided “as is” and “as available” without any warranty of any kind, whether express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

•       the Site will be available, uninterrupted, or error-free at all times;

•       any content or Resource is complete, current, or accurate; or

•       the Site is free from viruses or other harmful components.

Nothing in this clause is intended to exclude any consumer guarantee or statutory right that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any equivalent New Zealand legislation.

10. Limitation of Liability

To the maximum extent permitted by law, Jess Peletier Coaching trading as Scale School, its directors, employees, contractors, and agents will not be liable to you for any:

•       indirect, incidental, special, consequential, or punitive loss or damage;

•       loss of profits, revenue, business, data, or goodwill;

•       loss or damage arising from your reliance on any content or Resource on the Site; or

•       loss or damage caused by events outside our reasonable control.

Where liability cannot be excluded under the Australian Consumer Law or applicable New Zealand law, our liability is limited, at our election, to:

•       the resupply of the relevant service or content; or

•       the payment of the cost of having the relevant service or content resupplied.

Where the above limitation applies to a supply of goods or services under the Australian Consumer Law and the goods or services are not ordinarily acquired for personal, domestic, or household use, this limitation applies.

For the avoidance of doubt: nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law or equivalent New Zealand consumer protection legislation, to the extent that such exclusion would be unlawful.

11. Acceptable Use

You agree not to use the Site in any way that:

•       violates any applicable law or regulation in Australia, New Zealand, or your jurisdiction;

•       infringes the intellectual property rights of any person;

•       is fraudulent, deceptive, misleading, or harmful;

•       involves transmitting unsolicited commercial communications in breach of the Spam Act 2003 (Cth) or equivalent legislation;

•       involves the use of automated tools, bots, or scrapers to access, collect, or copy content from the Site;

•       attempts to gain unauthorised access to any part of the Site or any server, network, or database connected to the Site;

•       transmits any virus, malware, or other harmful or destructive code; or

•       interferes with or disrupts the integrity or performance of the Site.

We reserve the right to suspend or terminate your access to the Site, without notice, if we reasonably believe you have breached these Terms.

12. Privacy

We collect and handle your personal information in accordance with our Privacy Policy, which is available on the Site and forms part of these Terms. By using the Site, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

Our Privacy Policy sets out how we collect, use, store, and disclose personal information, and how you can access, correct, or make a complaint about our handling of your personal information.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Site, our practices, or applicable law. When we do, we will update the effective date at the top of this page.

Your continued use of the Site after any update constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

Where a change materially affects your rights, we will take reasonable steps to notify you, which may include posting a notice on the Site.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising under or in connection with these Terms.

Nothing in this clause limits the rights of New Zealand users under New Zealand law, including the right to bring a claim in a New Zealand court where applicable law so permits.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and (where applicable) any separate membership or service agreement, constitute the entire agreement between you and us with respect to your use of the Site.

15.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing to be effective.

15.4 Assignment

We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations under these Terms without our prior written consent.

15.5 Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms where that delay or failure is caused by circumstances beyond our reasonable control, including natural disasters, government action, pandemic, or failure of third-party services.
